Indie Hair Academy - Client Agreement

1) Agreement Overview
This Agreement is made between Indie Hair Academy (ABN 78 603 780 547) ("the Academy") and the enrolled student ("the Client"). By enrolling in the Academy, the Client agrees to comply with the terms and conditions set forth below.

2) CANCELLATION AND TERMINATION

A. Notice Period

• Clients may cancel their enrolment with one (1) month’s written notice via email to [email protected]  stating the reason for cancellation.

• Until the notice period is complete, payments remain due as per the agreed payment plan.

• Upon cancellation, access to all Academy resources, materials, and benefits will cease at the end of the notice period.

B. Commitment Expectation

• We expect all members to fully commit to the program by showing up to coaching calls, giving 100% effort, implementing all teachings, and engaging actively.

• Failure to participate may impact continued enrolment.

3) PAYMENT TERMS

A. Payment Obligations

• The Client agrees to make all scheduled payments as outlined in their enrolment agreement.

• If a payment defaults or declines, the system will attempt to deduct the payment again in 2 days from the nominated bank account.

• Failure to complete payments may result in legal action and referral to debt collection agencies, with all associated costs being the responsibility of the Client.

B. Payment Plans

• Payment plans are available and must be arranged at the time of enrolment.

• Any requests to amend a payment plan must be made in writing at least three (3) business days before the next scheduled payment.

• Any late payments will incur a 10% per annum interest charge, calculated daily.

4) COURSE COMPLETION AND RESCHEDULING

A. Completion Requirements

• All programs must be completed within 12 months from the date of enrolment.

• Extensions may be granted at the discretion of the Academy upon written request.

B. Rescheduling Requests

• Clients may reschedule workshops or sessions with at least 21 days' written notice.

• A rescheduling fee of $250 applies to changes made within 21 days of an event.

• Failure to attend a scheduled session without prior notice results in forfeiture of that session with no refund or credit provided.

5) INTELLECTUAL PROPERTY & CONFIDENTIALITY

A. Intellectual Property

• All materials, content, and resources provided by Indie Hair Academy remain the property of the Academy.

• Clients are not permitted to copy, distribute, or reproduce any course content for commercial purposes without express written permission.

B. Confidentiality Agreement

• Clients agree to maintain confidentiality regarding any proprietary information shared during the program.

• Breach of confidentiality may result in legal action.

6) LIABILITY & DISCLAIMER

A. Limitation of Liability

• Indie Hair Academy is not responsible for any personal losses, damages, or injuries incurred during participation in the program.

• The Academy does not guarantee specific business results from course completion.

B. Force Majeure

• The Academy shall not be held liable for cancellations or delays caused by unforeseen circumstances, including but not limited to natural disasters, pandemics, or government restrictions.

7) MEDIA RELEASE & NON-DISPARAGEMENT

A. Media Consent

• By enrolling, Clients grant Indie Hair Academy the right to use their images, testimonials, and course-related materials for promotional purposes.

B. Non-Disparagement Clause

• Clients agree not to make any negative public statements, including on social media, that may harm the reputation of Indie Hair Academy.

• Violation of this clause may result in legal action.

8) GOVERNING LAW
This Agreement is governed by the laws of Queensland, Australia. Any disputes arising from this contract shall be resolved in the applicable courts of Queensland.

ACKNOWLEDGEMENT & AGREEMENT
By enrolling in Indie Hair Academy, the Client acknowledges that they have read, understood, and agreed to the terms outlined in this contract.
